Is AAP misusing Mukhi's pictures projecting him as BJP's CM candidate?
Introduction:
AAP has been seen using Jagdish Mukhi's pictures against Arvind Kejriwal as CM candidate on auto-rickshaws. Despite controversial statements from Mukhi in this regard the campaign continued with the same picture in different auto-rickshaws. Jagdish Mukhi went ahead to send legal notice to Kejriwal in this regard and warned that he might even drag Kejriwal to court if he doesn't get an answer from AAP over "serious matter." Has AAP really done something so wrong that it should be dragged to court over this issue? The controversy doesn't seem to end that easily.
Yes, AAP is misusing Mukhi's pictures:
1. BJP has yet to affirm its candidates for CM and in this context AAP has no right to project one of the BJP leaders as CM candidate. This is where AAP crosses its limits and goes way too far in anticipating the other party's moves. Indeed Mukhi is right about claiming an answer from AAP over this kind of nonsensical act.
2. The pictures of Mukhi projected as BJP's CM candidates are seen on auto-rickshaws in different areas. This is violation of personal rights as AAP had no right to misuse an individual's pics its election campaigns. Without consent from an individual no political party has the right to use his pics in any manner good or bad.
3. AAP projecting a person as CM candidate for assembly elections that are scheduled to be held soon, when the party has not even announced its candidates is a wrong move which is misleading and is bent on spreading wrong message among the masses. As a chief ministerial candidate for assembly elections, Kejriwal is expected to take better decisions for election campaigns and not unethical ones such as this.
4. AAP lost the Lok Sabha elections against PM Narendra Modi in Varanasi and Kejriwal is afraid of history repeating itself. It is afraid of standing for a face off with Modi once again and is hence plotting such offenses against BJP to steer clear this time.
5. BJP has decided to contest elections under collective membership and the chief ministerial candidate shall be chosen by the senior leadership. This seems to have saddened AAP which has gone way ahead in calling it a face off between Kejriwal and Mukhi. They had always looked upon this as an opportunity but with this being a failure, they planned this move to draw attention.
6. This move by AAP can be seen as an attempt to create rift within BJP as there are many candidates for such a high position and such predictions are more likely to create differences between different candidates.
No, AAP is not misusing Mukhi's pictures:
1. BJP has always declared the name of its CM candidate but this time it decided to keep the cards hidden till the very final moment. In fact it was BJP that introduced the concept of CM candidates but this time they decided to play differently for the fear of losing to AAP and embarrasing a senior candidate. In this context if AAP predicts the move of BJP, it's not a crime to be charged for.
2. BJP definitely wants this election to be a face off between Kejriwal and Modi and that is probably the only reason for their condemnation of the posters depicting Mukhi as BJP's CM candidate. The posters simply asks who people want to see at their new CM - Kejriwal or Mukhi. If BJP has any other name as candidate, they should reveal the name instead of silly allegations.
3. The country sees Modi as a promising leader and just like all other recent elections where it was Modi v/s other parties instead of BJP on the whole, the same card is being played again this time. It is only a smart move by AAP to prove this strategy and there is absolutely no need for legal charges against this move.
4. Due to shortage of funds for election campaign, AAP used the posters as effective mechanism for communicating with the people asking for their opinion on who they view as a better candidate for the upcoming assembly elections.
5. Modi is already the PM of the country and unless he decides upon resigning from his post to contest in the coming elections, there is no reason for AAP to be afraid of Modi as accused by BJP spokesperson. Using Mukhi's pictures in auto-rickshaws is nothing offensive and hence no legal action should be involved in this matter.
Conclusion:
Whether or not Mukhi is to be BJP's candidate for the upcoming assembly elections is still not decided and AAP should have waited till the final approval to start with its picture campaigns on auto-rickshaws and over the social media where the posters went viral. BJP should also not delay the announcement of its candidate especially when it is sending legal notices to Kejriwal for predicting beyond limits.

- I think this is wrong done by Mr kejriwal to use the picture of Mukhi's bcoz the candidate for cm seat is not yet declared so there is no right to anyone to use opponent name with wrong predictions. May be the party has different strategy to fight elections with other name.At last this is foolishness strategy to fool the innocent voters. Thank u

- When BJP is yet to decide its CM candidate, it is definitely incorrect to use Mukhi’s pictures in their election campaign posters. The candidature for CM should have been announced by the party first. In a scenario when they haven’t revealed their candidate, AAP should not have chosen anyone in their campaign picturisation.
There is a possibility that AAP wants to avoid the Modi mantra, yet portraying someone else just for their escapism from hitting the Modi power would be wrong. Though AAP haven’t done anything offending in their posters, still they should have either waited for BJP to announce their candidate or they should have left the place blank in their posters for the BJP candidate.
It is also against the personal rights to use someone’s image for self utilisation. Though not defaming, yet campaigning against a person who is yet not chosen for the category is not acceptable. It could not be an offense so serious for legal prosecution, yet the matter can be flared up as per the requirement by Mukhi and BJP.
