Car parking area is the common area of the society as well as a necessity in today’s time. Why is it that the builders have to charge us extra for this space?

For:

- The developer should not be charging for an area which is a common space within the society, where in the developer is only entitled to sell the flat and not the parking space
- The commutation and conveyance facilities are not fully equipped in India, especially in places like Delhi NCR, Bangalore, etc. and hence people have to rely on personal mode of conveyance. If the public is charged for the parking within the societies as well, it would be a huge problem for the general public to travel
- The common area available in the society is limited, if the car parking is not charged, it will lead to a chaos in the society. Hence by charging the customers, they are allotting specific places for parking, will also help in reducing the fights amongst the residents on parking issues
- The builder has to construct a basement for parking purposes and hence he is charging the amount from the buyer

Against:

- Today each family has at least 3 – 4 cars, where in if the builders are not charging them for the parking space, the entire common space would be utilised with parking itself
- Metro cities are already facing the brunt of less parking spaces, be it within the societies or in market places
- When India is already fighting with pollution problems, there is a dire need to reduce the usage of cars and hence if people have to pay for parking space, it will help in reducing the number of cars to a great extent

Conclusion:

- Looking at the current scenario, it is necessary for the builders to charge the customers because of the increasing number of cars as well as the reducing space in the societies.

  • Although it is not economical and is unfair to the residents to pay extra amount for parking spaces, but in a world like ours where there is scarcity for space, it has become mandatory to charge flat buyers extra for parking space. With more than 2-3 cars per family, the number of vehicles is increasing in the cities like never before. In this case if parking space is not charged then a hell lot of chaos and mess will be created in buildings. The entire free area of the respective building or complex will be taken by cars and there won’t be any free space available for any other kind of activity. If free space is available, greenery and parks for kids can be made. And ample walking area for adults can also be chalked out. Moreover, to reduce the confusion and arguments between flat owners regarding parking space, it necessary to charge a separate amount. Once an individual pays for a particular space then that becomes his property and no one else is allowed to invade into that. By charging extra amount, usage of public transport is also encouraged which is beneficial to the entire economy. Hence, builders should charge the flat buyers for parking space.

    For:
    -The builders should not charge for parking space as the car parking area is the common area of the society. A developer can only sell a flat and has no right to sell a parking space. Once the occupation certificate is issued and the society formed, the developer ceases to have any title on the open space.
    -It is fair from a legal point of view. When a developer sells the rights of a flat to a buyer he charges not only for the carpet area of the flat but also for all common spaces and support structures built into the project. Builders incorporate all these costs into the market price of each flat they sell. So there is absolutely no legal basis to charge separately for parking slot.
    -In fact most states have laws and regulations that mandatorily require adequate parking spaces for securing project clearances.
    -Allowing builders to charge parking slots separately is also not economic especially at a time when demand for parking slots either doubles or even trebles in a very short span. However, free parking spaces will ensure that flat owners can at least attempt innovations like multi-level parking to maximise the number of parking slots and improve supply.

At the one end the move will force people to rethink buying more cars, while on the other, current car owners won't have to hunt for parking spaces on a daily basis.
    -Since parking space is scarce and valuable, it's best to apportion it through the market. Otherwise developers will pass on the cost of parking space through other means, and the person who parks a large number of cars will pay the same as the person who parks none.
    -Lack of parking space in India's metropolitan cities often leads to clogging of roads with cars even spilling out onto busy thoroughfares. Disputes over parking frequently turn into ugly fights, creating a law and order menace. Paying for parking is the only alternative.
